Describe the problem
For some readers (especially those with a literary background, unfamiliar with formalisms), this expression is a ambiguous : "when an e-book contains audio in addition to text".
Educational publishers are afraid it may apply in two cases :
CASE 1 : text + audio (before making content accessible) => OK though This deprives educational publishers of a pedagogical choice
CASE 2 : audio ressource + alternative text (after making content accessible) => absolutely KO !
Describe the fix or new feature you propose
To reassure educational publishers, it is important to clarify that the mediaoverlay requirement only applies when an audio accompanies a text, BEFORE making the publication accessible. But NOT when a TRANSCRIPT accompanies an audio pedagogical resource AFTER the resource has been made accessible (audio resource + alternative text).
In the first case, both text + audio are part of the ORIGINAL content of the publication.
In the second case, only the audio is part of the original content of the publication.
That's what Luc Audrain guaranteed us at the time, when we gave him our feedback on the European Directive,
we were very worried about this criterion.
